What does the pérdida de la nacionalidad (loss of citizenship) consist of?

The loss of Chilean citizenship includes the loss of the rights granted by being a Chilean citizen. This can occur in different cases as indicated in the legislation, either by renunciation of Chilean citizenship or by the loss of it.

Can I lose my Chilean citizenship if I acquire another one?

If you are Chilean by birth, you will not lose your Chilean citizenship because you are a citizen of another country, unless you voluntarily renounce it before the competent Chilean authority, as indicated in Art. 10 of the CPR (Chilean Constitution).

The competent Chilean authority is understood to be: the Chilean consul, if the interested party is abroad; or the Servicio Nacional de Migraciones (SERMIG), if the person is in Chile.

Where should I apply for Renuncia a la nacionalidad chilena (Renunciation of Chilean citizenship)?

If you are abroad, you can apply at the respective consular authority. Otherwise, if you are in Chile, you can go to the Oficina de Partes of SERMIG, located at Calle San Antonio 580, Santiago. In both cases, you must present the letter or document to certify citizenship in a foreign country.

Requirements

To apply for renunciation of Chilean citizenship, you must upload the following documents to your application:

  1. Letter or affidavit expressing your willingness to renounce Chilean citizenship.
  2. The renunciation of citizenship must be preceded by citizenship in a foreign country, which must be certified.

Can I regain Chilean citizenship?

Citizenship may also be recovered only for those citizens who have lost it under Art. 11 of the Chilean Constitution (CPR.)

Can I apply to have the annotation of loss of nationality removed?

If you are a Chilean citizen who lost your citizenship for having acquired citizenship in a foreign country under the text of the Chilean Constitution prior to Law No. 20.050 (published on August 26 of 2005), which records the annotation of loss of Chilean citizenship in your birth registration, you can apply for this annotation to be removed, using the following form:

Where should I go to apply?

If you are abroad, you can apply at the respective consular authority, and if you are in Chile, you can apply at SERMIG. In both cases, presenting the Application Form, the Birth Certificate showing the registration of the resignation, and the document certifying the current citizenship.

This application will be sent to the Servicio de Registro Civil e Identificación (Civil Registry and Identification Service) , so that it can proceed to the elimination of this annotation.
